Abstract: Well-organised and predictable jurisdiction is the foundation of social peace. When the Second World War ended, Germany was in ruins, however, and the hard task of rebuilding the country, including the establishment of the justice system, awaited the Germans and the victorious Allies occupying Germany. In the Soviet occupational zone, criminal procedures lacking the rule of law were started, with the indictment for collaborating with the National Socialist regime. As a result, four fifths of people working in the justice system lost their jobs. The process of establishing the new system of jurisdiction was characterised by concentration of power and subordination to political interests. In the recruitment process, superseding of political opponents proved more important than professional expertise.
